FRANKSTON FRAUD FURORE: Bolano banshee busted with bogus "ballot box" in Health union

A false Health Services Union “ballot box” at the Frankston Hospital has been used to intercept and enable unlawful interference with postal ballot papers in the hotly contested election. The scam “ballot box” is installed for the purpose of improperly obtaining members’ votes to ensure they’ve voted for the “right” group. It is in no way authorised by the Australian Electoral Commission.

BOGUS BALLOT BOX IN PUBLIC HOSPITAL
Photographic evidence obtained by VEXNEWS shows that an HSU delegate aligned to the Marco Bolano team, fifty-one year old Frankston supply department storewoman Lindsey Read has been advertising and operating a bogus “ballot box” for the purpose of collecting voting papers in the election.

Those familiar with the matter – speaking on condition of anonymity out of fear about what Read would do to them – say they are confident that a forensic analysis of a number of the Frankston ballots will literally reveal Read’s fingerprints all over them. If criminal convictions occur, it could be enough to land the delegate – believed to have been promised a job as an organiser by Bolano – behind bars.

In order to cast an effective vote in the election, union members are required to complete their own ballot paper, seal and sign the outer envelope and post it back to the Australian Electoral Commission. Lindsey Read and others linked to the Marco Bolano campaign stand accused of rorting that process by their opponents.

Not only is the fake ballot box a breach of the HSU’s own rules they say, but legal experts have told VEXNEWS that vote-tampering and interfering with ballot papers is a breach of federal and state law including the Crimes Act.

CRIMINAL INVESTIGATION
The evidence and allegations have been forwarded to the Chief Executive of the hospital, Australian Federal Police and the Australian Electoral Commission who are operating the postal ballot.

Frankston was once considered the “heartland” of the charismatic Labor moderate Jeff Jackson’s powerbase in the union during his time dominating the union. Under his leadership, the union nearly doubled in size and for a while it seemed to go from strength to strength. Jackson was later white-anted by internal office opponents who mostly support the Doug Byron ticket. Times have changed but a couple of the Jackson old guard delegates are still in place despite losing a lot of support among the members due to the troubles in the union in recent days.

Some members say that Read and some of the old guard have been muscling voters to hand over ballot papers or deceiving them by pretending there’s a “ballot box” where they can put their vote rather than post it as intended by the Australian Electoral Commission and required by the union rules and federal law. A member told VEXNEWS:

“I haven’t seen Lindsey open the voting papers but it’s no secret she is there to ensure Bolano gets votes. She has been promised a job in the union office if Bolano can scrape back in.”

These claims – if proven – could spell serious legal trouble for the Bolano team, as their opponents in the Byron and Asmar camps say they are trying similar arguably corrupt tactics elsewhere.

FEDERAL COURT
The stink over the fake ballot box adds to the legal trouble faced by the Bolano team which has been fending off Federal Court allegations that they misused union resources to assist their union election bid.

The court order that recently appointed the Health Services Union administrator, John Vines, also specifically prohibited the use of the union’s resources for campaigning in the election and ordered that the union be administered in a non-partisan way during the election.

Election observers say that the theft of union property for campaigning could constitute an “irregularity” that could potentially see a candidate disqualified and even prosecuted.

The Bolano team have been accused by rivals in the Asmar and Byron group of using union resources including letterhead and the union franking machine to promote campaign meetings.

While the Federal Court Justice Tracey did not order a stop to the election or Bolano’s disqualification, he did note with grave concern that the use of the union’s own money in that way was “certainly improper.” Six sets of lawyers representing Diana Asmar, Marco Bolano, the national office of the HSU, the Australian Electoral Commission, Doug Byron and the court-appointed HSU Administrator all attended the hearing. A lawyer’s picnic. Bespectacled Bolano backer Rob Elliott, the former national secretary married to popular state Labor upper house MP Kaye Darveniza, also attended the hearing, nervously relaying reports back to the Jacksons and Bolano supporters. The Bolano camp were relieved with the result but are worried that the stage is being set for a legal challenge in the event they are successful.

Since then new evidence has emerged that the Administrator John Vines is wantonly allowing union staff (including candidates) to organise what are advertised as official “union meetings” (promoted by mail and poster on HSU letterhead) which are actually used by Bolano candidates to promote themselves in the election. Vines has sent one email memo politely asking that this not occur but according to one HSU staffer speaking on condition of anonymity is presiding over a “systemic corruption of the union’s resources to rort the election. They’re laughing at him… some have taken leave but are still using union cars and union letterhead and the franking machine to promote their candidacy. Our union is left as the laughing stock.”

BACK IN FRANKSTON
It’s the kind of ugliness that political observers have come to expect out of what the Sunday Age described as “Australia’s most dysfunctional union.”

When confronted on Sunday with allegations of vote rorting by VEXNEWS, Lindsey Read was none too pleased, initially threatening our reporter’s safety, attempting to smash our camera, literally spitting venom and profanity in an ugly display that could see the fifty-one year old supplies tsar crowned “Miss Scrubber (Frankston region) of 2009″.

Read admitted running the fake ballot box, saying she was perfectly entitled to “collect all the votes and tickets she wanted” and that “it was none of your f*ckin’ business what I do in my hospital, you fat c*nt.” The little hurricane also patrols the hospital grounds – on time she’s paid to be working – looking out for Bolano opponents and then teams up with the hospital management to remove them. One shaken union member at Frankston who’d had a gutful of Lindsey Read’s antics told VEXNEWS:

“The union has delivered me nothing for the six years I’ve been in it. No EBA. I very nearly resigned my membership but stayed when I heard there was an election so I could vote these crooks out. Lindsey uses the bosses in HR (Human Resources) to keep out anyone who wants to clean up the union, it’s pretty f*cked when the union can’t deliver pay rises but can get the boss to keep out people who want to fix the union so it works for the members not the bosses. If this keeps going, there won’t be a union. It’s disintegrating.”

While the Federal Court Justice Tracey did not order a stop to the election or Bolano’s disqualification, he did note with grave concern that the use of the union’s own money in that way was “certainly improper.”

Despite the four foot not much feisty little fifty-something wearing a charming ensemble of white tank top with ill-fitting black bra, she was an intimidating and frightening sight for our reporter who explained that her over-bearing and scary nature put her in the league of “CFMEU Construction bully boys half-cut in the midday sun at their annual picnic. Only she wasn’t drunk. Just really mad. Hopefully Marco can put the little feral back on the leash.”

Believed to be assisting Read in the vote fraud scam was an unnamed accomplice working in the sterilising area near the union noticeboard who is also an HSU delegate. The unnamed and behatted individual has also been accused of being “in sweet” with hospital managers, even calling security to remove opposing campaign workers from the Doug Byron and Diana Asmar teams from publicly accessible and taxpayer funded areas like the cafeteria.

HOSPITAL MANAGEMENT INVOLVED
Sources told VEXNEWS that a nursing manager Ann Lindsay had ordered non-Bolano campaign workers from Frankston Hospital on Sunday in a move that has already attracted formal complaints about her conduct to the board of Peninsula Health, the state government and the Australian Electoral Commission. Lindsay is believed to have been encouraged by members of the Bolano team to act in a highly partisan and irregular way that could see her reprimanded for involving herself in the internal politics of the Health Services Union.

A Bolano supporter told VEXNEWS “You’re making a big deal out of this. Marco wouldn’t do anything that would corrupt the election process. It might be just someone taking initiative to encourage people to vote, you’re assuming evil intent because that suits the story.”

They hadn’t met Lindsey Read and wouldn’t comment on her thuggish and improper behaviour. “I’ll try to find out what’s going on down there but what you’re saying doesn’t sound right… she might have been feeling a little territorial.”

DISCLOSURE: VEXNEWS is friendly with candidates and supporters on all three sides of this highly unusual three-way contest within the HSU that pits the corners of the Victorian Labor Right against each other in a no-holds caged wrestling contest. We’ve tried not to let our support for all of them interfere with reporting fairly on these amusing events.

Do the supporters really believe that the only problem with the hsu is the dud spending? At the moment all runners look like duds. As ive said bfor the trouble goes back ten years and maybe even further. Maybe what should have occured instead of an election is deregistration, dare i say it and a refund of all members dues for the past two years, whoose for that. then a gradual rebuilding of the union from the ground up

Executives at Peninsula Health have been mis-respresenting survey results for years. they set a bad exasmple to staff. eg if 30% of staff return a survey and 70% don’t (as they know it will make no difference) then it is reported to the board of directos that only 30% had issues and 0% obviously were not concerned about working conditions etc. Lindsay is a good person – give her a break

    Candidate for Secretary of the Health Services Union, Mr Doug Byron said he was bitterly disappointed by yesterday’s announced closure of the Sea Lake Hospital and associated aged care facilities in Victoria’s North West.

    “My first priority is to protect the jobs of HSU members. This means standing up for the organisations in which they work – health facilities are critically important pieces of infrastructure in rural Victoria and they should not be closed on a whim”.

    The Board of the Sea Lake and District Health Service announced yesterday that the Sea Lake facility would close next month at the expense of approximately forty health worker positions.

    “We share the frustration and outrage that has been voiced by the Sea Lake Community in response to this decision”.

    “We will be joining the Community in directly petitioning Minister Andrews, to ensure that Government is doing all it can to save this important health facility”, said Mr Byron.

    “Facilities such as these are as important to the prosperity and livelihood of country Victoria as the local shop or the post office – they keep our State moving forward”.

    The Sea Lake Hospital and associated aged care facilities are not-for-profit community owned services that are jointly funded by the State and Federal Governments.

    The facilities contain acute care and emergency beds and are home to 28 permanent aged care residents from the local community.

    “It is my understanding that these facilities generate around $1.8 million in wages alone each year – and if you take that away from any small Victorian community you are effectively signing its death sentence”, said Mr Byron.

    Closure of the facility will mean that some aged care residents may be forced to move up to an hour away in order to find appropriate housing, cutting them off from their local community.

    Hospital Board President Laurice McClelland indicated that the decision to close the facility was taken principally due to financial considerations.

  98. Doing an internet search for info and found this site. Well well well. What a wealth of information for me, a lowly member from the country.

    I was going to vote Asmar as new blood, fresh, different with no links to the current idiots in there but then got cold feet when I found out that she is a career politician. Maybe on the up and up and using a mostly female membership to get there? She has jumped around a lot form job to job, so I think she is just trying to get into a position in the labour party and the union will be left far behind to this priority for her. In the dvd I was not impressed as she looked like a rubbish talker and I wouldnt trust her in a pink fit. But thats just me.

    Then I looked at the Byron ticket and was put off by so many people on it that were on the committee when it got the union into this position. Also I am worried that Fegan will comeback in once elected and that would not be good at all for anyone and i would definatley resign if that happened.

    So I am left with Marco’s team which to me, I admit, I was a bit hesitant because he seems pretty full on and linked to the good old Jacksons. But then I thought that I actually want someone to lead that will be the opposite of our bosses, a good old fashioned unionist, that won’t pussy foot around, suck up to the bosses, play political games. I want someone who is going to command respect from employers as at th end of the day with all of this outsourcing we have a big fight on our hands. He will just get in there and go for it and thats what we need. That is what I see union representation as or else we just become ineffecitve.

    So I am going to vote for Marco’s team as he seems the most genuine for the job he is going for and doesn’t seem to have any political aspirations as many of the other people running do to get higher than running the HSU.

    So there is my two cents worth, lets see what happens.

The HSU deserves the chance to be lead by someone like Marco – honest, strong, and most importantly: in it for the members, and the members only. The same can be said for Carol and Jamie. What a team! And their ticket – members from all sectors, not just a handful of hospitals.

    The lowlifes trying to smear Marco have been at it for 12 months, when they realised he was a threat to their greedy ambitions. Prior to that, they all loved him. Says a lot doesn’t it!!

  103. I am astounded to hear of the disgusting campaign to muddy Marco’s name. I am a member, and needed the union’s help a couple of years ago. Marco assisted me to stand up to managers who were bullying me and my colleagues. My initial impressions of Marco? Honest as the day is long, passionate about making sure we were getting a fair go, and smart as a whip.
    Marco will be a revolutionary leader of the HSU. Why? Because he actually gives a shit and he has integrity. The vast majority of members who have had contact with Marco will all report the same. Bring on the election result! Onwards and upwards!
