James Ashby’s law firm scolded by Federal Court after leaving sex harrassment accuser financially devastated #auspol

The law firm Harmers that represented James Ashby in his clearly politically motivated litigation against former Speaker Peter Slipper last year has again been reprimanded by a Federal Court judge.

The firm insists it bankrolled its client’s case against Oracle and suggests it will pick up the tab completely for costs orders against her.

It seems likely the firm has done the same thing with Ashby too.

  1. I do not believe Harmers will pick up Oracle’s costs on an indemnity basis. Usually, no win no fee cases are run on the basis that the lawyers don’t charge you but you are up for the other side’s costs if you lose.

    The settlement offer by Oracle was clearly generous ($85,000) compared to the amount awarded after trial ($18,000).

    Oracle made a commercial decision to try to end the litigation and any properly advised plaintiff should have been exhorted to accept the offer.
