LESSONS: Craig Thomson gives strong account of himself but those advising silence in the past were dead wrong

The witch-hunt.

VEXNEWS has started a few.

It’s the one thing that pains us greatly about the pure pleasure of producing VEXNEWS.

A target is selected. Claims are made. A frenzy ensues. The normal rules that govern our behaviour about each other get quickly suspended in the excitement.

Well, that’s what’s happened in the Craig Thomson affair.

Indeed, in this case, we’ve had the person making the claims – Kathy Jackson – given a virtual immunity from public criticism or any real accountability about her involvement in what now appears to be a widespread fraud on the members of the HSU, perpetrated by herself and her associates.

We’re contrarians here, so we don’t like the double standard and don’t like to cheer lynch-mobs along.

Thomson’s account of events was calm, strong and – even to our cynical mind – highly persuasive.

But the Parliament was never going to be the place where his guilt or innocence.

Thomson made a damning critique of Fair Work Australia that warrants urgent review.

Thomson reminded the Parliament of the serious claims of wrongdoing against Kathy Jackson and her cadre of con-artists that remain – to this day – inadequately investigated by Fair Work Australia.

He disclosed that Kathy Jackson’s partner – former Opus Dei member Michael Lawler – is “on leave” from being Vice-President of Fair Work Australia. VEXNEWS has previously reported on his extensive involvement with Jackson’s internal union and political activities. He ought to stand aside, but apparently has no plans to do so. Jackson and Lawler have apparently loudly told people within the HSU that it’s “illegal” to criticise a Fair Work Australia member. That isn’t the case, their empty threats won’t spare them the justice they deserve. It is Michael Lawler who has – in our opinion – acted in manner we believe to be beneath contempt.

Thomson reminded the media to observe some courtesies, singling out an unnamed Seven Network reporter who apparently hovered around the bathroom, while his pregnant wife was taking a shower. That was the only point in his remarks where the MP lost his calm composure.

Thomson gave the speech of his political life today. And in that speech – in its quality – we see great tragedy.

He’s a talent. He bravely gave this speech, without reading it. He drew from notes occasionally but basically just spoke from the heart, from his own knowledge. Few of his parliamentary colleagues could do this, we suspect, especially not on such difficult, intricate issues where his lawyers would have urged caution over ever utterance.

The tragedy is that for a long, long, long time, Thomson was clearly told to keep schtum. To stonewall. To be stoic. What a wholehearted political disaster that has been.

Leave no shot unanswered. That’s what we believe.

And hasn’t it been astonishingly endorsed by this whole saga. Dignified silence has cost this talented, ambitious high-flying political talent a great deal.

All political folk reading this should be haunted by this saga. And learn from it. If someone accuses you of doing the wrong thing, and you haven’t done it, you owe it to yourself, and loved ones, to ignore the cautious besuited advisers who urge silence in the face of grave claims.

  10. Having watched Thomson give his explanation to the Parliament I am of the firm view that he has the right of innocence and that his exoplaintaio0n has merit. Most notable was the flaws in the process of the Fair Work Commission and the role played by Michael Williamson.

    The media have placed themselves in the position of being prosecutor, jury and judge. The scurrilous attack by the opposition has seriously undermined public confidence in due process and the rule of law. Their action is a clear abuse of parliament, if allowed to continue would bring the parliament into further disrepute and set a very dangerous precedent.

    We have already seen the double standards lack of principle and recklessness in the oppositions opportunistic gutter tactics.

    While unions get a bad rap, private enterprise is let off the hook. The most cynical exercise is Joyce’s announcement of 500 heavy engineering job cuts at Melbourne Airport at the same time Thomson was making his speech. Trio Superannuation collapses leaving over 5000 victims of fraud. The High Court finds that Hardie Directors failed in their duties in approving a misleading ASX announcement about the state of funding for asbestos victims.

    Anyway, I am much impressed by the real investigative journalism undertaken Vexnews. I now realise that the mainstream press, especially Fairfax (Michelle Grattan et al) and the ABC (7.30 report) have been very selective in their reporting on this issue.

    This journalist refuse Thomson a right of reply and gave Jackson carte blanche , where is the code of ethics for journalists, they are as responsible for peddling assertions and accusations disguising them as fact fuelled by a desperate opposition of the likes of slimy Pyne and Abbott .

  14. I agree Thomson gave a very convincing speech, and I believe what he said. He came across as an intelligent, thoughtful person who would do the right thing. However, I was disappointed that there were hardly any Labor members present to support him while he spoke. Are they using the excuse that Thomson is now an independent so what he says has nothing to do with them? I thought this looked gutless.

    Will she address the myriad conflicts of interests? and why her partner second in charge of FWA did not stand aside whilst the FWA investigated her Union ?     Here are just a few of the key issues that he completely failed to address:

    Why he approved payment of what he claims were fake claims for prostitutes on two of his union credit cards.

    Why he did not go to police when the fraud surfaced.

    Why he has refused to talk to NSW police since.

    Why he needed so many cash withdrawals, and what the money was spent on.

    Why he claimed to have returned unspent cash withdrawals often, when the union official responsible for receiving such returns says she cannot remember him doing so once.

    Why he claimed Fairfax had been told by its handwriting analyists that the signatures on the brothel payments were not his, when Fairfax denies having had any such advice.

    Why he had no union approval for hiring two people with union money to work on his election.

    The Left are kidding themselves if they truly believe Thompson has cleared himself!

    Or, they could actually investigate Thomson’s allegations. Here’s an idea. Why not get a view of her from a cross-section of the Victorian HSU members allegedly ripped off by her? Why not ask her some specific questions about specific allegations such as ‘Did you destroy documents?’ Why not ask her if the real prize in all this has all along been the HSU and the influence peddling she could control as its head?

    Or, dear journalists, if you can’t do any of that, at least stop strewing her malodorous and grubby path to power with roses.

    1. Identify your target.

    2. Have accusations made and then have them referred to a government body for “investigation”.

    3. Report the accusations as fact.

    4. Hound your prey, make them “prove they are innocent”.

    5. At the end of the “investigation” if nothing is found, keep the story going reporting words like “dodged a bullet” or “not officially charged” or “will be the subject to ongoing investigation”

    Grattan & Mclimont & 2 examples where truth was obfuscated for a headline and towing the populist line. Getting facts involves going against the grain of the “pack” .

    Pyne & the LNP are great media finessers , i mean why would you scratch the surface and worry about fairness and process when it’s a minority Govt? Had it not been i guarantee this “theatre” would not have ocurred.

    Thomson eloquently pointed out the “lynch mob” mentality , and the separation of parliamentary and judicial processess , even quoting to kill a mockingbird to illustate the parity of everyone in the law’s eyes , and how judicial process should determine a persons “guilt” not parliament.

    The fact that a very Senior Legal officer of the FWA who has strong ties to the accuser and the LNP did not step down through the FWA investigation is of great concern.

    Which brings us to why a very senior Judicial officer in the FWA did not step aside given the close ties to the accuser of the whole affair, but choses to step down now?

    The bigger the tragedy, the bigger the story and the more sales.

    One sided attacks over something as juicy to public morals as prostitutes makes great headlines.

    Balancing the story in the view of the media hacks undermines their own argument and looks like they are trying to have a bob each way.

    Splash out a grabbing headline, ramp up the salacious claims and run the accusations as though they are God’s own words.

    That’s how the modern media work and Abbott & Libs know just how to feed that beast.

    Did Thompson say he did not use the HSU credit card for whore mongering? No.

    Did Thompson explain why he used HSU funds for his private (ALP) campaign in the Division of Dobell? No.

    Did he say that he got permission of the HSU to use their members money for his personal (ALP) campaign? No.

    Donations from trade unions, public and private companies and lobby groups to political campaign should be banned. Donations should individual donations only and then limited to $10,000 per election.

    If indeed he was set up and victimised it almost makes things worse as the culture and endemic misappropriation of HSU members funds has then been ratified by a party so desperate to stay in power that it turned a blind eye to the very principles that it was founded to protect.

  62. I have tried to stay objective in listening and reading all this negativity surrounding the union who’ve I’ve belonged too for several years. The one thing I found interesting is after listening to Chrisopher Pyne, the Lib attack dog, and both the reply’s from Kathy Jackson and Marco Bolano is the three of them were so obviously reading of the same hymn sheet. It is so very obvious that Jackson and Bolano are working so closely with the Libs to destroy not only Thompson and Williamson and not only the HSU union but the entire union movement. To all those Jackson / Bolano fans, play back the media conference by Pyne and the reply’s by Jackson and Bolano and then say to yourself that a so called union official, who is meant to e so proud to fight for the battlers is working so closely with the Libs. Then see if you call Jackson a hero ????

Thomson gave a very broad brush treatment to the allegations and findings against him, it was not a particularly convincing performance and there is a number of things that bother me greatly that have not been answered. One is why? I work in a union that has had its fair share of dickhead national secretaries rorting workers while they wait for preselection or some other cushy job. Basically most of the ‘worker bees’ in the union are just waiting for them to go, they are glad to see the back of them so why would anyone do anything to ruin the career or keep it up after the person has gone? It makes no sense to me. Some of Thomsons claims are very disingenuous such as demanding the footage from brothels, they were escorts, it would be better to call for the CCTV from the hotels he frequented if they keep CCTV footage and I doubt they do. He did not explain anything in regards to the whopping cash withdrawals nor did he even attempt to deal with the Communigrafix allegations. I was not at all convinced by todays performance. Whilst I can almost believe anything when it concerns the Right of the ALP, this was just a little too bizarre and Thomson while saying plenty actually when it is boiled off he said very little. I am also sick of the media treatment of it all and the lack on any investigative skill. Why aren’t they asking and investigation why the union is so dysfunctional? The media mentions ‘factional warfare’ but who drives those factions and who stands to gain from whichever factions rules? Who is really controlling the HSU and who stands to gain from the government level? Whose numbers are they; which ALP politician gains from them? Thomson resolved nothing today he just had his chance to bite back at people whom by all accounts are allegedly as bad as he is.

  66. This is a union folks, I wouldn’t give any of them the time of day, and most sensible people wouldn’t give them a job hence they work for a union. So we are starting of a low base. However Mr. Thomson’s rambling but clearly prepared (he had notes) speech today was more interesting for what he didn’t say.

    He didn’t say:

    1. I have never used union funds or a union credit card on prostitutes.
    2. I have never withdrawn union cash from an ATM and used it for my own purposes.
    3. All the questioned expenditures including those on my election campaign were properly approved by the union.

    What about;

    – All we still have is a series of allegations. Thomson is not charged with anything (as Brandis was keen to point out this morning, in order to justify the continuing parliamentary and media witch hunt against his target).

    – Craig Thomson’s accuser (Kathy Jackson) is in far deeper and more serious water than he is.

    – Kathy Jackson’s husband, Michael Lawler, is the #2 at the organisation which has produced this so-called adverse report.

    – Lawler is a judge of a Federal tribunal responsible for regulating unions. There are now allegations that he personally intervened into a factional dispute that Jackson was engaged in, threatening HSU industrial officers, then reporting them to police with alleged details of internal HSU emails attached. This right here is a deeply serious national scandal going right to the heart of the FWA’s impartiality and capability.

    – the FWA report in any case, is not a brief of evidence, it’s not at all compiled with the rules of evidence in mind (so its not admissible in a court). The AEC report shreds key parts of the FWA’s report.

    – But against all this, the media have decided that Thomson “seems guilty” (I mean … PROSTITUTES!) and that’s enough for the hangman to be called.

    – In regards to the media, ABC and Fairfax in particular, but of course News Ltd always love a good Union/ALP kicking, so what media outlets do we have left? It’s left to bloggers and online news outlets to actually uncover new information (i.e. Lawler’s activities which are certainly extremely serious allegations, far worse than anything levelled at Thomson, and this morning completely ignored by the ABC and Fairfax).

    It seems pretty clear that the HSU was run like a criminal organisation. Why should we dismiss the notion of a set-up? This seems to have been the default mechanism to call dissidents into line. Thomson’s allegations are well worth testing, but not through the bent perspective of the live-in lover of the complainant.

    Its not up to the opposition to use this as a way of stopping due process. You have no right to pronounce him guilty, nor do they. No matter how much you might want to. It just doesn’t work that way. You are expressing an opinion and yes you can do that just as I am expressing mine. But the opposition does NOT have that right in parliament. They asked him to explain himself – he has. They do not get the right to cross examine him. It isn’t a court of law.

    I see it for what it is. The opposition being opportunistic at the expense of another persons right to innocence. I hope that what comes out of this saga is that everyone takes a long hard look at what oppotunism, and mud slinging, from both sides does for due process. The only person as far as I can tell who is behaving with any dignity at all is the Prime Minister herself. She has accepted Thomson’s wish to be placed on the indepentents bench in an effort to try to get some oxygen back into the policy debate. Stuff that actually matters to our economy. But of course the opposition want the focus on Thomson because they see that as a way of grabbing the prime ministership for Abbott.     Wrong, in fact. Thomson accused Kathy Jackson, effectively, of having her nose in the trough. This accusation has no bearing on the substance of the allegations against Thomson himself. It can only go to Jackson’s credibility as an accuser. The accuser with dirty hands may be telling the truth about you but loses the moral authority to be pleased with herself. 

    She has subsequently been asked about her salary, her car, child care fees and overseas trips. Her answer was that they were ‘approved’. 

    The problem is that a common theme in the allegations against HSU officials is that immoderate spending was not ‘disapproved’ (for salaries for example) but that this was a product of poor rules and therefore did not make it fair, appropriate and ethical. 

    In principle the allegations against Jackson seem no different from many of those against Thomson and Williamson – taking advantage of loose controls to dig out excessive entitlements.

    In a fair world this should either cause the media to make further inquiries – or to be as hostile to her as to Thomson.

The FWA is an independent body, and unless you have proof that the Labor party saught to extend the time it took to do the investigation you are just conjecturing. There are serious allegations that Thomson denies. He is afforded the presumption of innocence, just like any other citizen. Why is that so difficult for you to understand.   168. I follow this not as a member of the HSU, but as the former husband of a HSU Victorian state secretary.

    My ex-wife was someone whose politics I’m keenly aware of from the early-eighties…but even though she’s no longer a part of the HSU, from what I read here her time is still remembered with some distaste.

    What I find most interesting about the whole current HSU debacle is the fact, as usual, you have right-wing people who are more likely to emasculate any effectiveness the union has and cause much division in it.

    I’m of the opinion my ex, Zora was one such case.

    It’s such a pity such people as her and Kathy Jackson seem more intent on serving agendas other than that of their members’ wellbeing.

    I am politically centrist myself and have been for years, but tend to think you always need a strong union movement as a counter-balance to the employer groups to have any semblance of fairness. That doesn’t happen when the unions have right-wingers causing division.

    Whatever the eventual resolution of all this current mess, I hope at least one lesson is learnt that the HSU should not have to constantly be a house divided.

    At least Zora failed to achieve a similar object in 2002. Sadly, it’s people after her who are now doing what I feel Zora was trying to do to the HSU No.1 Vic branch.

    He’s allowed the presumption of innocence till PROVEN guilty. And I believe Kathy Jackson needs to explain the conflict of interest she has in her relationship to an FWA person before she goes throwing allegations around.

    Seriously…if there is corruption in the HSU, it’s not just on one side. And politics is always a dirty business. Which is why people like myself switch off to it and veer away from either extremes of it.

    But in this case…I don’t feel accusations thrown at Thomson and others are without bias from the opposite side of the political fence.

  173. Any new Anti-Corruption Commissioner would have to have rocks in their head to accept anything less than $270k, especially if the scope takes in claims regarding MPs, journos, Union officials, FWA Members and staff!

    FWA recently botched an investigation I requested. Simple complaint, a Union gives out the contact details of a de-registered member so that FWA can serve a Summons to witness for an Unfair Dismissal hearing. The witness told the Applicant (dismissed employee) and the Union months prior that the Summons had to be signed and stamped by FWA for them to attend. The Applicant, the Union and FWA all failed to heed the basic Summons requirements in plenty of time before the hearing so that the witness can give notice to the employer legitimately to attend. FWA staff leave a message on the witness’s home answering machine a day before the hearing and threaten that if they don’t turn up after being served the signed Summons by email, they will face imprisonment. The child of the witness listens to the answering machine message and is distressed. The witness returns from their fly-in-fly-out roster to find the email and the answering machine message. The Union failed to tell FWA that the witness was no longer on the Membership roll. FWA directed the Union to serve the Summons on its Member!! (why would you be a Union member if they are supposed to protect you and your privacy) When FWA were told it had no authority under its Rules to insist the Union serve the Summons by email because the witness was not on the Roll – everyone ducked. The result, the witness didn’t make it to the hearing, or the rescheduled hearing because FWA would not return calls to accommodate the witness, the witness didn’t go to prison, the child is still scarred, the findings don’t cover the facts and instead are a cover up for the Union & FWA acting in concert … the only reason the investigation findings were issued in the same year as the complaint was because I wrote to Bill Shorten stating I’d go to the media if it wasn’t investigated promptly.
    The smuggler asked the PM today – which one is more believable, the FWA findings or Thomson’s response to the findings … if Lawler, Abbott’s appointee or any of his mates had a hand in it, I’d say Thomson.

    For those that think that ACAs story is a smoking gun, you should first realise that a Prostitute has sold everything that she has already, so obviously money is a big incentive, but more importantly the credit card statement that they showed actually may have helped prove his innocence, as Peter Wicks’ article “Thomson under the rain” showed a photo of the credit card imprint used as forensic evidence against Thomson, in the original defamation case,
    and the imprint clearly shows that the name on the card was Thompson with a ‘P’ not Thomson, which is the name on the statement shown on ACA tonight.
    A friend that worked for Visa for a number of years told me tonight that the card used was almost certainly not the card provided by the the bank as the names on both would be spelt the same , either both with the ‘P’ or both without.

    The HSU is being vilified by the Union movement – bad move for the Unionists who are being ever so puritanical in their zeal to show their relative integrity. There are plenty of scandals in other unions that have been hushed up for the good of the movement.

    I suspect the HSU leadership (whose members presumably include the people who wheel the trolleys of dead people to the hospital morgue) knows where some of the most disgustingly dismembered bodies are buried and will be digging up those rotting carcasses for all to behold.     except that he did not say that she could not recall it, he just stated that this was proof that CT misled parliament. He then went on to say that FWA was Labors baby and that all the appointments were Labors.
    He, like all the LNP are quick to claim CT misled Parliament, but what about misleading the people senator?
    Is there no penalty for that?

  347. FAIR Work Australia has rejected claims made by Craig Thomson that one of its most senior officials had sought to influence the outcome of its investigation into the suspended Labor MP.

    Appearing before a Senate committee today, FWA president Iain Ross insisted he had not been provided “with any evidence to support the allegation” that Michael Lawler, the partner of Health Services Union whistleblower Kathy Jackson, had interfered in the long-running probe.

    Mr Ross, in a written statement to the parliament, also side-stepped allegations of “bias” levelled against the FWA by Mr Thomson during his hour-long statement to federal parliament last Monday.

    He said “any allegations of bias” can be tested in the Federal Court which will be asked to adjudicate on FWA’s findings that Mr Thomson is guilty of 156 separate contraventions of workplace laws during his time as HSU national secretary.

    “You can f . . k off and take sick leave if you don’t want to do the work and still be paid, but you can’t resign,” Mr Lawler allegedly told her.

    A few days after Mr Giudice approached Mr Lawler about Ms Glen’s complaint, Mr Lawler wrote to NSW Police making allegations of criminal conduct against her. In his letter to the head of Strikeforce Carnarvon, which is investigating alleged corruption in the HSU, Mr Lawler claims Ms Glen and HSU East acting assistant general-secretary Gerard Hayes may have engaged in a criminal conspiracy. Ms Glen and Mr Hayes strenuously deny Mr Lawler’s allegations.

    Mr Lawler claims Ms Glen may have been given an inducement to give false evidence, noting that in a private email exchange with her partner in December, she had referred to a cheque she was going to pick up.

    “I had ordered a bank cheque to pay my rent,” Ms Glen said, questioning how Mr Lawler had obtained her emails. She says she finds it extraordinary that Mr Lawler, the second highest industrial judge in the land, would engage in such a campaign.

    “Nothing is impossible and I am confident of winning because Labor has a good story to sell in NSW,” Mr Wicks, of Kellyville, told the Times.

    “Basically I am sick of inaction and we have a bunch of politicians who take their constituents for granted.

    “This is a strong Liberal area and their politicians think they don’t have to work for their seats.

    “Though I am new to politics, I have been a keen observer of politics for some time.”

    Mr Wicks, who turned 43 yesterday said the Liberals are reluctant to talk up their policies, making the voters wary.

    “Labor has a real policy and we have many positives to talk about, unlike the Liberals who are unwilling to talk of their policies or don’t have any,” Mr Wicks said.

    “One of the main reasons I am contesting is because I am very concerned about the Liberals’ standing on social issues such as disability.

    “In fact, the Labor Govt has committed to $2 billion in disability funding.”

    A successful businessman, Mr Wicks is confident the recent resignations and clean out of several Labor MPs is the best thing to happen to the party.

    “It’s a changing of the guard basically and it does make the party younger and vibrant,” he said.

    Iain Ross, nor for that matter Michael Lawler, have any power over the General Manager.

    Its called natural justice to provide a copy of a complaint to the accused.

    The President of FWA (then Guidice) knew of Lawler’s relationship with KJ from the beginning, when Jeff emailed him expressing his unhappiness at sharing his wife with the VP in charge of the health panel!

Conroy and Shorten smoothed it all over for her (with subsequent far reaching consequences in these 2 now having key positions in Govt) and Gillard was hidden in Brumbies office, rehabilited, and then given a safe seat as payoff.
    In all – Gillards entry into the political stage has an amazing parallel to Craig Thomson. A corrupted nepotistic union/affiliate with form in stealing, grafting and lying their way into power.

The Protect Trust Deed like any trust deed requires that an employee needs to fulfil certain criteria in order to claim on the fund. The administrators of the collapsed company did not make the workers redundant they kep them on the books but not getting paid; a common ploy by receivers/companies to keep the work and profits ticking over for the shareholders but a terrible situation for workers who are in a limbo. It is designed to force them to resign if they do they lose redundancy entitlements and this is a financial plus for the receiver and the company it reduces liability. In negototiating a redundancy these workers now have certainty, they might not have jobs but they are no longer economic hostages of Hastie. This is a pretty good outcome for ETU members and a good move by the union. It is the only way they could legally access their entitlements you morons. I am sure if the ETU had have breached the Trust Deed you would have been baying for blood over that as well. You are all f*cking idiots and the dregs of the union movement.

This morning, I watched the reaction of two of the right wing media hacks (and I mean hacks in the most detrimental sense of the word) jump up on their high horses of righteous indignation because CT had the temerity to laugh at the puerile antics of tony Rabbot and Christopher Pain trying to run from parliament.
    Those well known media icons Karl Stuckwithnodick and Biteyer Buttrose, who have taken great delight in declaring CT guilty at every opportunity, showed their collective hands by instead of roasting the ‘one who would be king’ for his childish reaction, they blamed CT for acting as an independent, which he is as a result of the right wing harassment.
    Biteyer getting particularly hot under the collar because he (CT) had a smile on his face.
    Now CT showing his support for defeating the gag motion was, I believe, his way of standing up to the bully boys ( and girls), and saying that he was not frightened by anything that the LNP has to say, and after years of accusations, lies, half truths and innuendo, against him I think he has the right to crack a smile when he has the rare opportunity to show the LNP for the idiots that really they are, and the puerile pantomime that the parliament has become, as a result of the win at any cost and born to rule mentality of the opposition!

    I didn’t really organise any roots in a brothel.
    I just paid the ladies and they did all the organising.
    Even though I paid for having a root I think they really liked me.
