SCHMOZZLE: Union of patriots tears itself to pieces
The fight for control over the Health Services Union #1 branch in Victoria is likely to have implications for the ALP as an arm-wrestle starts over who gets to appoint the union’s delegates to Party decision-making forums.
The fight is between union president Pauline Fegan and union secretary Jeff Jackson.
We understand that yesterday the Pauline Fegan dominated Branch Committee of Management resolved that they would appoint Fegan friendly delegates to ALP decision-making bodies, rather than Jackson allies.
Some dispute this decision will “stick” because they say it’s the Secretary’s prerogative to appoint ALP conference delegates.
In the context of an ongoing fight within the Labor Right their change of allegiance could be seen as quite significant, although it is increasingly rumoured that one-time friends turned feudsters Bill Shorten and David Feeney have had very fruitful talks on behalf of their respective sub-groups and that an outbreak of intra-factional peace could be imminent. In that case, any changing of the guard at the HSU fortress might not mean as much as it otherwise would for the ALP.
PATRIOTS WHO JUST CAN’T GET ON
Both Fegan and Jackson are supporters of the Labor Right. Both have supporters from within its ranks, with Jackson being at the centre of the Ambition Faction, a sub-group commanded by Senator David Feeney. Feeney was instrumental some years ago in assisting Jackson’s election, defeating allies of then NUW Grand Poobah Greg Sword who normally might have been expected to win but his eyes were off the ball due to trouble with a certain receptionist. Or so the story goes.
Fegan is less involved in factional matters but has allies who are also within the Labor Right, principally it seems among Jackson’s enemies. Jeff’s version of subtlety includes launching public jihads against his own faction’s senior party officials, so it’s not surprising he has a few foes. That said, the protocol in these things is the party organisation and MP’s don’t get involved in internal union fights and it seems both sides are strictly adhering to that. Just as well.
Disturbingly though, one of Fegan’s supporters on the union’s Branch Committee of Management, like its board of directors, is closely associated with the CFMEU Construction division, a union that maintains close links with organised crime and itself conducts business in a way that would do Al Capone proud. We can only hope those connections are minimised. Just as those at the NUW who pursued dialogue with Bill Oliver, the CFMEU’s current state secretary would be well advised to keep a safe distance.
Both sides have made allegations of wrongdoing against the other, in a way that appears to cancel itself out, almost.
ALL HAIL THE BCOM
Fegan’s principal weapon in her war against Jackson is what now appears to be an overwhelming majority on the Branch Committee of Management to cause Jackson trouble of all kinds. It is certainly an unusual situation to have a BCOM act in that manner. Normally union BCOMs are as compliant and docile as a well-fed puppy dog. But Fegan has done well to turn them to her side. Her allies say it’s less about what she did and more about the B.Com members’ concerns about how the union is being run.
She’s used this majority to good effect, getting clearly hostile gun for hire auditors in to review every aspect of the union’s and Jackson’s financial dealings. Such an inquiry directed at anyone, anytime is unlikely to be helpful to them. That has been the case here. Ominously, their report is an “interim” one and it is proposed it will go back further than the current eighteen months of inquiry.
BUT DON’T UNDERESTIMATE THE JEFF
Jackson – though outgunned on the BCOM- is a feisty, wily and charismatic figure who is going to fight like a cornered animal. Any suggestion that he is going to go quietly is strongly rebutted by his impassioned self-defence. He reportedly maintained a vigorous account of himself on the Jon Faine show on the ABC this morning and sounded like a chap just warming up for a long fight.
A fight among patriots for control of a union patiently rebuilt after years of darkness under Greg Sword’s allies is a sad thing indeed. It has already cost a lot of money. It today leads to a front-page denigration of Jackson in Melbourne’s most appalling newspaper The Age. Other newspapers reported on the matter but much less sensationally.
THE AGE’S LIES
They insist the Victoria Police is investigating Jackson. The Age’s shameful record of implying criminality by claiming Police are investigating matters is a long and tiresome one.
Ironically perhaps, after a stoush involving one of the HSU’s former staff Alexandria Hicks, The Age asserted that various of her sometime friends, sometime frenemies at the University of Melbourne were being probed by Victoria Police, the ATO, the Federal Police, ASIC and some other agency, possibly the United Nations. We were one of these treated as a frenemy, although had perhaps rather naively treated them all as mates who deserved any support we could muster from a distance. The Left were the principal source of these persistent and very distracting lies but sadly they weren’t the only source. These faux patriots have mostly been dispensed with, one by one, by Mossad trained snipers. Only kidding, but their obscurity is our monument. Some seek refuge in electorate offices, but no sanctuary lasts forever.
Our example is a small one. We think of the travesty of justice done to former Cabinet Minister Theo Theophanous, accused of a very serious crime in a drive-by front-page attack that left Melbourne shocked at the depravity and injustice of the publication. When he is acquitted, they will have much for which they will answer. We think of a federal MP who was falsely linked to the fleecing of a community group despite his only link to it being to actively oppose the person who had done the fleecing. There are so many examples.
So having travelled on this BS Express, we can’t help but feel sympathy for the Jeff. Like his Liberal namesake, he is a crash-through or crash kinda guy. We hope he crashes through and suspect he will.
OUR RANT CONTINUES
Sure enough, nearly five years on, we’re still waiting to hear from these agencies. Jackson will probably have the same experience now.
Despite an avalanche of bad press, not one phone call or piece of correspondence was received from a single regulator. We weren’t so much cleared of these claims, fanciful inventions and grotesque distortions, as found to be so disconnected from them that we weren’t worthy of even the mildest of inquiry.
Despite The Age repeatedly and falsely asserting their investigations were on the verge of having us hang by the cojones for flogging in a public square, there was nothing. Only now can we look back and chuckle. But we’ll never forget. We will watch that institution of evil slowly and painfully die, in our lifetime, on our watch and we will celebrate it here.
We can only hope the patriots at the HSU can sort out their differences, which seem ultimately to be a clash of rival egos and personalities, so they can focus on looking after their mostly battler members at a time of skyrocketing unemployment.
Attempting to criminalise a political dispute is not something we ever like to see. It’s all too often and common these days. We hope it is not rewarded.

THE state president of a major ALP-affiliated union has been suspended after being accused of trying to “extort” money from the union.
The accusation against president Pauline Fegan is part of a bitter fight for control of the Health Services Union No. 1 branch, which is a key player in Premier John Brumby’s right-wing faction.
Police were called in this week to investigate claims of misuse of members’ funds by warring officials of the union.
Ms Fegan, who vehemently denies the extortion accusation, was suspended by her rival in the internal war, union secretary Jeff Jackson, on Monday.
He acted after receiving a letter from assistant secretary Shaun Hudson accusing the president of threatening to further destabilise the union unless she was given a payout of more than $250,000.
Ms Fegan said last night: “I deny the charges. I believe they have been laid to try to prevent me from fulfilling my responsibilities as union president.”
She said it was no coincidence that she was informed of her suspension the day before a meeting of the union’s management committee, which decided to charge Mr Jackson under union rules with misappropriation of funds and to call in the police.
Mr Jackson told Ms Fegan in a letter sent on Monday that she had been charged by Mr Hudson with “gross misbehaviour and gross neglect of duty”.
“In light of the charges and their serious nature and circumstances, I have decided to immediately suspend you from your office as branch president pending the determination of the charges,” Mr Jackson wrote.
In a letter to Mr Jackson earlier on Monday, Mr Hudson accused Ms Fegan of saying she would leave the union only on the condition that she be paid out “the full value of the conditions of employment” — an amount calculated by Mr Hudson at more than $250,000.
“Fegan’s conduct discloses a clear attempt by her to extort money from the union,” Mr Hudson writes.
The Jackson forces have called a mass meeting of members for next Wednesday night to discuss the union crisis. Ms Fegan’s backers are trying to stop the meeting, saying it is part of a push by Mr Jackson to gain unfettered control.
The union’s national secretary, Kathy Jackson last night called for an end to the “cycle of allegations and counter-allegations” in the Victorian branch.
Ms Jackson said the national office supported calling in the Industrial Registrar to fully audit the state branch. She flagged the prospect of the national office intervening in the state branch.
“If we form the view that it is wasting its resources in a profligate way, then action will have to be taken,” she said.
Ms Jackson said union money had to be directed to services for members, not on fees for lawyers acting for warring union officials.

As a long standing member of the HSU I am frustrated that my union can clearly spend so much time, money and energy on this – the employers are laughing at us!!!
The number one branch EBA is currently destined to go the same way as today’s number three branch determination – a hopeless result. Less than 2% payrise in real terms for the first two years, no career path, no solution to the long standing grading issues that have plagued rural workplaces… and we have waited 18months to be chastised for the poor behaviour of OUR union (under the stewardship of Ms Jackson).
If only there was an alternative to being a member of the HSU – I am genuinely contemplating saving my union dues like so many others have already. Why should I fund this??? We never see the union officials anyway (I have asked for a visit to our worksite THREE times – I don’t intend asking a fourth time).

Members of the HSU who read this comments section, ponder for a moment the type of behaviour you might have witnessed if you were to have dined with the protagonists in this affair in happier times.
This is what you would have seen. At a head table commandeered by an advance party, a loud plump woman denigrating staff members as they arrived for lunch. Staff who elected to sit on distant tables so as to get out earshot, despite plenty of empty seats around the loud lady.
You would have seen Pauline ordering the most expensive seafood platter on the menu – especially if she is not hungry – so that those around her are forced to stare at this untouched tower of excess and be left in no doubt about her importance.
In this company, Jeff would be attending to a simple pasta and actively engaged in conversation about a current pressing issue and the upward direction of the union.
Possibly that conversation will be taking place with a new employee (also eating a pasta) who the union has been able to employ thanks to the growth that the union has experienced under Jeff Jackson.
Surrounding Pauline will be her perennial lunch companions, generally the most incompetent staff in the office, sipping on chardonnays and cackling about their last lunch together.
This is what you will see. This is what I have seen. Time and again.
And to me it marks out the differences in approach, integrity of these two players.
I know which one i would like to sit down and dine with as we talked about getting the union back on track.
BCOM members I know this tableau will be ringing true to you. Ask yourselves, are you really in this for the members because god knows Jeff and his entire staff are, or are you here to gorge at a table of excess that Pauline has promised. And will that table be set for you when you get to it?

Let me respond regarding your complaints about your EBA.
1. Your current EBA is still in force, so it is not legally possible to have a new one yet.
2. Secondly the Fegan camp in running ‘the delay in the EBA’ line clearly demonstrate their incompetence and stupidity, as any pre 1.7.09 EBA will be a Workchoices EBA.
Why don’t you ring the ACTU, and enquire regarding the wisdom of concluding an EBA prior to 1.7.09. They will say, you would have to have rocks in your head.

The millionaire lifestyle of the Jacksons includes a property portfolio that will soon be confiscated under proceeds of crime laws. The Balwyn property is worth $2.5 million including pool and grounds. Is money is buried here under ground in waterproof cannisters “for a rainy day”?
It will soon be raining quite a lot as the St Kilda Road Fraud Squad pore over ever invoice, receipt, bank statement and give both Jacksons a thorough probe.
Kathy Jackson cannot be immune from this. She too has explaining to do as her finances have co-mingled with her tainted husband. She drives another union car, another luxury European vehicle. The accusations levelled at Fegan are ludicrous. She is accused because she dares to tell the truth about the millionaire lifestyle of the Jacksons. Her partner has a successful business that sold goods to the union, at Jeff Jackson’s request. While Jackson stores the union’s financial records at the bottom of Port Phillips bay, this business keeps every record and can prove it delivered every single item it was paid for. It made a very slender profit, around $10000, in an entirely normal transaction that was signed off on by Jackson. Because Fegan blows the whistle on Jackson’s embezzlement, she is targeted with a smear. It doesn’t compare even slightly with the systematic plundering from the HSU by the Jacksons that made them both millionaires.

Jeff won’t answer these questions. He knows the end is coming. Kathy knows too but wants a seat in Parliament as her golden parachute. She is instead going to get a golden shower from the members.
She knows the main reason Jackson’s crimes are so well known is that he boasts about them when drunk off his skull. His only hope is that bad health kills him before he’s behind bars reflecting on a life of crime.
Jackson’s defense is that Fegan is a crook too. That might work with the few left at the union who have faith in Jackson. But it doesn’t wash in the Supreme Court.
Time to dig up the money because the game is up.

I have some questions that I would like answered, like why you feel justified in asserting that I have some reason to throw in my cards.
Will you have the courage of your convictions to post material in your own name in future? I doubt it very much. If you had to do things the honest way you would have to stick to the facts, and the facts tell a very different story to the nonsense you are peddling in your 1am rantings.

Policeman, law clerk guilty of offering bribe

A police officer and an articled law clerk were yesterday found guilty of offering $20,000 to another policeman for favourable treatment of an accused drug trafficker.
A County Court jury found that Senior Detective Darrin James Flett and Ali Aydin conspired to bribe Senior Detective Stephen Trewavas, who was in the St Kilda criminal investigation unit with Flett at the time.
It can also now be revealed that Aydin, an articled law clerk at city firm Yianoulatos Lawyers, and another former law clerk Helmut Kirsch, were found guilty this year of threatening Senior Detective Ben Archbold over a case involving standover man Housam Zayat, who was killed in Melbourne’s gangland murders.
Mr Archbold, who later became a star of reality TV’s Big Brother 3, told the court he was terrified that notorious criminal Nik “The Bulgarian” Radev wanted to kill him after Aydin said Radev wanted his home address. Radev later became another victim of Melbourne’s underworld killings.

The offences started in April 2001, after Senior Detective Trewavas arrested alleged drug trafficker Reyn Rekhviashvili. The Crown said that soon afterwards, Flett told Senior Detective Trewavas the arrest could be worth some money.
He said: “All you have to do is look after him” and told him there was $20,000 on offer, but that he would take “five for the leg work”.
About two months after the arrest, Aydin, Flett and Senior Detective Trewavas were at the Men’s Gallery in the city when Aydin – who claimed to be Rekhviashvili’s solicitor – said he would receive $50,000 from his client for keeping him out of jail, and that Senior Detective Trewavas would get $20,000 if he changed a summary in the brief of evidence against Rekhviashvili. A few days later, Aydin asked Senior Detective Trewavas if he wanted his money in cash or casino chips.
Around the same time, Mr Archbold was investigating Zayat and Radev over an assault at a city hotel where a man was dangled from a ninth-floor balcony. At the Men’s Gallery meeting, Aydin told Senior Detective Trewavas that he represented Radev, who wanted to know the home address of Mr Archbold.
The court was told that on July 4, 2001, Aydin threatened Senior Detective Archbold with law suits, caveats and criminal charges in a bid to get bail and reduce charges against Zayat. He was later joined by Kirsch, who said he had Archbold’s home address and described Radev as an “armed, loose cannon”.
Kirsch, formerly known as Greg Middap, was previously a managing law clerk at Yianoulatos Lawyers. He has convictions, including being an accessory after the fact in a double murder and heroin trafficking.
Aydin and Flett were found guilty of conspiring to pervert the course of public justice in relation to Senior Detective Trewavas. Aydin and Kirsch were found guilty of intending to pervert the course of public justice over the threats to Mr Archbold.
Kirsch, 47, of North Melbourne, Flett, 33, and Aydin, 29 – both of undisclosed addresses – will be sentenced at dates to be fixed.
