Yesterday in the AIRC she continued with her campaign to sack three union workers by using the workchoices legislation, agruing that the AIRC had no jurisdiction because the union has less than 101 employees. By these specific actions alone, that women has disgraced herself, the union and all her supporters. She stands condemned. And I understand she has just put in an application to join the ALP which she has been previously on record as saying she despises. I further understand she has the blessing of and will return the favours of a former Union official now in the federal parliament who wants the HSU numbers at the next state conference and beyond.

The secretary of the cash-strapped union representing hospital cleaners has taken Federal Court action to prevent the union’s committee of management seeking a $450,000 overdraft.

Infighting within the Health Services Union No.1 branch was brought to a head late last week with secretary Zora Marko also seeking orders allowing her to take control of the union’s finances, to direct staff and receive union correspondence.

Ms Marko was elected secretary last year but claims she has not been able to act because of a hostile branch committee, which appointed former secretary Pauline Fegan as president.

Ms Marko claims Ms Fegan and national liaison officer and former branch assistant secretary Jeff Jackson have sidelined her and taken over the union.

Labor sources say the infighting is a result of a internal Labor Unity factional brawl, with Ms Fegan supported by Victorian ALP secretary David Feeney and Ms Marko supported by national ALP president Greg Sword.

Ms Fegan and Mr Jackson, who was appointed campaign manager, were behind the industrial action earlier this year when hospital cleaners, porters and caterers imposed limited bans seeking pay parity with nurses. Action was halted after a hearing in the Australian Industrial Relations Commission in March. No resolution has been reached.

The union has an operating deficit of $468,000 so far this financial year and net assets of $1.5million.

Ms Marko claims the branch committee applied to the Bendigo Bank for the overdraft, which placed a mortgage over the union’s building, without her knowledge. She wants a Federal Court order to halt the overdraft while she receives independent financial advice.

According to an affidavit tendered on Ms Fegan’s behalf, the branch has had an operating deficit since 1992-93.

“The branch has funded this operating deficit by the non-payment in good time of accounts. In effect the branch would write cheques for the bills received but would deliberately delay sending the cheques. This meant that the branch did not overdraw its accounts,” according to the affidavit.

Ms Marko has organised a special general meeting of the union tonight to propose a rules change to force elections for the branch committee of management this year.
