The proposal to scrap the smaller state branches of the National Union of Workers has ran into a serious legal hurdle.
Despite succeeding with a national ballot to scrap the WA, SA and Queensland branches earlier in the year, the Industrial Registrar has reportedly refused the bid by union national secretary Charlie Donnelly to press ahead with the rules changes that would give effect to the ballot.
The option is still open to Donnelly to pursue the issue on appeal to the Federal Court but some believe that unlikely given the emphatic rejection by the Registrar.
Half a million dollars has already been spent on getting the proposal approved and the state branches effected continue to oppose it, as could be expected.
The issue of the scrapping of the state branches is sure to be a live issue in the looming union national elections next year, with Donnelly facing a big push from the smaller but feisty NSW branch and their smaller state allies.
Legal insiders have expressed surprise at the Registrar’s decision although they say the national office’s approach to the issue was radical, pressing on without the consent of the state branches or the approval of the membership in each state. Interestingly the decision makes it clear that wasn’t the issue, it was the “oppressive” nature of the rules change in terms of its impact on the state branches which were to be scrapped without having much say in the operation of the General branch that was to replace them.
Perhaps this means the national office could press on with the rules change but only if they left the existing WA, SA and Queensland officials in charge of the general branch. And we cannot imagine Charlie Donnelly wanting that at all, especially now.
So it’s either back to the drawing board or off to court. No wonder Charlie’s been keen to delegate ALP political issues to his wily liege Antony Thow, the secretary of the Victorian branch of the union. He’s got a lot on his plate.
