POOL OF INFINITE PLEASURES: Billionaire Solomon Lew risks jail by defying order to remove illegally built pool

Billionaire Solomon Lew has failed to comply with a ruling of the Building Appeals Board to remove his infamous and dangerous illegally constructed swimming pool at Osprey Avenue, Mt Eliza.

VEXNEWS has learned that local MPs and constituents have been told by the Department of Sustainability and Environment by a Rodney Warren, the director of the Port Philip region that:

“I can confirm lawyers acting for Shuttlehall Pty Ltd (the owners of the adjoining freehold land) have been advised that the Crown land on which the pool is located is not available for sale.”

“In addition, the Buildings Appeal Board has ordered that the retaining walls and fill on the Crown land must be removed. Mornington Peninsula Shire and the Department of Sustainability & Environment are working together to ensure the removal of the walls and fill does not damage the natural values of the surrounding coastal Crown land. Given the complexity of the works and the sensitivity of the natural environment, I anticipate that planning for these works and all necessary approvals should be in place by the end of 2011.”

“Options to remove the pool are also being considered. However, to protect the integrity of the investigation and possible actions, I am unable to comment on this stage of the process.”

It’s obviously going to be an expensive exercise, in order to ensure the public safety and to protect the sanctity of the nature reserve, so rudely vandalised by the billionaire and his cash-in-hand up-market builders of choice, Krongolds, who are denying all connection with the pool, despite being dropped right in it by Lew and his hobbling lawyer, Sam Bond.

While the pool furore has been going down, sources familiar with Lew’s movements say the anxious billionaire – whose retail empire is under huge pressure – has been recently overseas. He and his chum ex-billionaire Gerry Harvey have been trying to distract unhappy investors by continuing to push for a GST on online shoppers.

Harvey complained in today’s press about nasty online comments following his tax-push. “I was attacked and called all sorts of things. I was the vermin of the bloody earth,” Mr Harvey said.

Harvey whined about tweeters and even Taiwanese news animators that tore him a new one:

He said a Taiwanese-produced animation attacking him, billionaire former Coles Myer boss Solomon Lew and Myer chief Bernie Brookes had made the top six of Tweets worldwide. The animation showed them crying and pleading to have the GST applied to purchases on overseas websites under $1000.

Back in the leafy confines of millionaires’ row in Mt Eliza, the brave and true Mornington Peninsula Shire Council intends to seek an enforcement order from the Magistrates Court directing Lew to comply with the lawful order of the council that he remove the illegally constructed pool built on a protected nature reserve on public land overlooking a beach.

The council have had to take emergency safety measures to protect the public from the possibility that Lew’s pool could collapse and injure passers-by.

If he – and his daughter Jaki who occupies the house as a weekender but used Daddy’s money to buy it – refuses to comply with the court order, it is within the power of the Magistrate to find him and Jaki Lew in contempt of court and imprison them both – and/or impose fines – until the order of the court is complied with.

    So be it. Let the rule of law take it’s course – and quickly. Justice delayed is justice denied. Whatever the outcome, that’s that! If good old Solly and family end up in the slammer, then too bad.

  14. There is no chance of a jail sentence for anyone if there is merely failure by a company to comply with a court order.

    That’s one of the reasons why the smart money puts real estate in the name of a discretionary family trust managed by a corporate trustee.
